The Supreme Court has heard two cases asking the justices to overrule the Chevron deference in Relentless Inc. v. Department of Commerce and Loper Bright Enterprises v. Raimondo. Under Chevron, courts must accept agency interpretations of ambiguous laws instead of allowing Congress to interpret them through the democratic process.

A favored tool of the Biden administration, Chevron rests power in the hands of unelected bureaucrats almost always to the detriment of working Americans. The cases before the high court began as challenges to the National Oceanic and Atmospheric Administration's (NOAA) at-sea monitor program, which places observers aboard commercial fishing vessels to monitor fishermen while they work.

According to the fishermen, the program is intrusive, unsafe, and imposes excessive financial burdens on their businesses. Every day, it is threatening local fishing economies, livelihoods and America's food supply. The costs of this program, in human and economic terms, are significant.

In short, Chevron is a tool wielded by the powerful, in this case the Biden administration, against the powerless: America's fishermen.

  1. Loaded language "Betrayal", "destroy", and "suffering" are very emotionally charged words used to describe the impact of policies in an exaggerated way rather than by factual assessment. And describing Democrats as no longer aligned with "heart and soul of working Americans" and characterizing supporters of wind energy initiatives as the "far left" are definitely efforts to categorize and label groups in a selective, politically biased way. These phrases are examples of rhetorically loaded and emotionally manipulative language interspersed throughout the article.
  2. Quotation out of context This does not appear to be a valid interpretation and application of Justice Gorsuch's quote about Chevron deference. His full comment goes into much more nuance about issues with Chevron, and is not addressing the fishing industry, but rather some applications of Chevron to other constituencies (such as veterans and immigrants). And Forbes takes Gorsuch to be assigning motive and blame, calling Chevron "a tool wielded by the powerful...against the powerless." Gorsuch did not ascribe intent like that or directly apply his statements to Biden and fishermen.
